A CONSTITUTIONAL QUESTION

            I have a puzzler for us, today.

            Read carefully these portions of the constitution. I invite you write us and tell us your opinion of them. They deal with the Schiavo case, but they also deal with any state that refuses to grant it citizens true justice.

No bill of attainder or ex post facto Law shall be passed [by congress]. Art I, Sect 9-c.

However,

The United States shall guarantee to every state [in this union a republican form of government, and shall protect each of them against invasion; and] on application of the legislature, or of the executive (when the legislature cannot be convened) against domestic violence. Art IV, Sect 4.

and

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted. [this has been ruled as judgments, too] VIII Amendment

notwithstanding

The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively [, or to the people.] X Amendment

because

The powers are reserved [not only] to the states respectively, or [but also to] to the people [as an entity within the state of residence]. ibid, X Amend.

            Did the states, by creating "family courts," violate these portions of the Constitution? If so, are any of their rulings valid? Or do their rulings constitute cruel and unusual punishment?

            Notice that there is plenty of evidence for the pressing of civil rights, and it is odd that none of them were used by the movement in the 50's & 60's. Their clear arguments, however, speak eloquently, when clarified by the 13th and 14th Amendments to just such rights for all.
